The mobile application 'Grivana' and any associated website (together, the "Platform", and together with the services made available through it, the "Services") are owned, operated and made available by Saimorphix Innovations LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008 (LLPIN: ADA-0394), having its registered office at D-701, Vaikunt Dham Co-Op Hsg. Soc., CTS No. 163-163/17 to 89, JM Road, Bhandup, Mumbai – 400078 (hereinafter referred to as "Grivana", "we", "us" or "our", which expression shall, unless repugnant to the context, include our affiliates, successors and assigns).
This Privacy Policy ("Privacy Policy") sets out the manner in which Grivana collects, receives, stores, processes, uses, discloses, transfers and otherwise handles personal information and other information of Users and Providers (each as defined in our Terms of Use) in connection with their access to and use of the Platform and the Services. This Privacy Policy does not apply to information that you provide to, or that is collected by, any third party (including a Provider or a Payment Processor) through the Platform, or through any third-party website, application or service that you access in connection with the Services.
This document is published in accordance with the Information Technology Act, 2000 and the rules made thereunder, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules"), which require the publication of a privacy policy for the collection, use and disclosure of sensitive personal data or information. We request that you read this Privacy Policy together with our Terms of Use, available on the Platform, before you access or use the Platform or avail of the Services.
This Privacy Policy applies to Users and Providers (each as defined in the Terms of Use). For the purposes of this Privacy Policy, the words "you", "your" or "User" refer to the person who accesses or uses the Platform in any manner or capacity, including a Provider where the context so requires.
By using the Services or the Platform, or by otherwise providing us with your information, you agree to the terms of this Privacy Policy and expressly consent to our collection, use, processing, storage and disclosure of your Personal Information (defined below) in the manner described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Platform or the Services.
Capitalised terms used but not defined in this Privacy Policy shall have the meaning ascribed to them in the Terms of Use.
1. Information We Collect
We collect information from you in the following ways: information you provide directly to us, information generated through your use of the Platform, and information we receive from third parties in connection with the Services.
1.1 Personal Information
We may collect the following categories of personal information ("Personal Information"):
- Identity and contact information: such as your name, phone number, email address, and pickup/delivery address(es), provided at the time of registration or booking;
- Account credentials: and information you provide while logging in or out of the Platform;
- Booking-related information: such as details of the Laundry Services requested, garment or fabric-care instructions, special handling requirements, and delivery preferences;
- Payment-related information: such as payment method, billing details and transaction history, processed on our behalf by our Payment Processor (we do not store your full card, net-banking or UPI credentials on our servers);
- Identification proof: where furnished by you to avail certain Services, as permitted or required under the Terms of Use;
- Communications you send us: including messages, feedback, complaints, reviews or ratings about a Provider, and any correspondence (such as emails) between you and us; and
- Additional information: any additional information you may choose to provide to us on a case-to-case basis in connection with the Services.
1.2 Non-Personal Information
We may also collect non-personal information that does not, by itself, identify you ("Non-Personal Information"), including your IP address, device identifiers, operating system, browser type, internet service provider, app usage logs, pages or screens viewed, booking and usage patterns, cookie data, and other diagnostic or aggregate data automatically captured through your use of the Platform.
1.3 Feedback and Reviews
Where you submit reviews, ratings or feedback about a Provider, or a Provider submits feedback about you for quality-control purposes, as contemplated under the Terms of Use, we collect and retain such information as part of your account records and to operate and improve the Services.
2. How We Use Your Information
We use Personal Information and Non-Personal Information for the following purposes:
- To create and manage your Account, and to identify and communicate with you;
- To provide, operate, and facilitate the Platform and the Services, including arranging bookings with Providers;
- To process payments through our Payment Processor and to raise, verify and reconcile Charges and Fees;
- To send booking confirmations, service-related alerts, administrative notices, and (subject to your consent or opt-out rights) promotional communications via SMS, email, WhatsApp or push notification;
- To respond to your queries, complaints, feedback or grievances and to provide customer support;
- To verify your identity and eligibility to use the Platform and the Services;
- To monitor, improve and personalise the Platform and the Services, and to conduct internal research and analytics on usage and demographic patterns;
- To detect, prevent and investigate fraud, security incidents, and other unlawful or prohibited activity;
- To administer offers, discounts, trials, contests or promotions in accordance with the Terms of Use;
- To comply with our legal, regulatory and contractual obligations, including in connection with the Grievance Redressal mechanism under the Terms of Use; and
- For any other purpose disclosed to you at the time of collection, or to which you otherwise consent.
3. Sharing and Disclosure of Information
3.1 Providers
To fulfil a booking, we share such Personal Information as is reasonably necessary with the Pickup Partner assigned to that booking (such as your name, contact number, and pickup/delivery address), so that the Pickup Partner may perform the clothes pickup service.
3.2 Payment Processor and Service Providers
We share payment-related information with our third-party Payment Processor solely to process your payment, subject to the Payment Processor's own terms and privacy policy. We may also share Personal Information and Non-Personal Information with vendors who support our operations, such as cloud hosting, communications (SMS/email/WhatsApp), analytics, and customer-support service providers, solely for the purpose of enabling them to perform services on our behalf. Our arrangements with such parties restrict them from using your information for any purpose other than providing these services to us.
3.3 Legal and Regulatory Disclosures
We may access, use, preserve, and disclose your Personal Information to government authorities, law-enforcement agencies, courts, or other private parties where we reasonably believe such disclosure is necessary to:
- (a) comply with applicable law, regulation, legal process, or a valid governmental request;
- (b) enforce our Terms of Use or investigate potential violations;
- (c) detect, prevent, or address fraud, security, or technical concerns;
- (d) protect the rights, property, or safety of Grivana, our Users, Providers, or the public; or
- (e) prevent or stop activity we consider illegal, unethical, or harmful. Such disclosures may be made without prior notice to you where permitted by law.
3.4 Business Transfers
If Grivana is involved in a merger, acquisition, restructuring, sale of assets, or similar transaction, your Personal Information may be transferred to the relevant third party as part of that transaction. We will notify you of any material change in ownership or in the manner your Personal Information is handled as a result, and any such transfer will be carried out in accordance with applicable data-protection law.
3.5 No Sale of Information; No Spam
Grivana does not sell your Personal Information to third parties. Except as described in this Clause 3, we do not share your email address or phone number with third parties for their independent marketing purposes without your consent.
4. Cookies and Similar Technologies
- The Platform may use cookies, SDKs, device identifiers, and similar tracking technologies ("Cookies") to recognise your device, remember preferences, and understand how the Platform is used.
- We use information from Cookies to maintain your session, personalise your experience, measure the performance of the Services, and diagnose technical issues.
- We may use aggregate or anonymised usage data derived from Cookies for analytics and to improve the Platform.
- Where analytics or communication vendors integrated into the Platform independently place Cookies or similar technologies, their use of such technologies is governed by their own privacy policies, over which Grivana has no control and for which Grivana accepts no liability.
- You may be able to manage or disable Cookies through your device or browser settings; doing so may affect the availability of certain features of the Platform.
5. Your Choices and Opt-Out
You may decline to provide certain Personal Information, in which case certain features of the Platform (such as booking a Service) may not be available to you. You may opt out of promotional communications at any time by writing to us at support@saimorphixinnovations.com. Please note that opting out of promotional communications may affect our ability to notify you about certain bookings, as noted in the Terms of Use, and does not affect service-related or transactional communications necessary for us to provide the Services.
6. Data Retention
We retain your Personal Information for as long as is reasonably necessary to provide you the Services, and thereafter for such period as is necessary to comply with our legal and regulatory obligations, resolve disputes, enforce our agreements, prevent fraud, and complete any activity connected with the closure of your Account. If you have consented to receive marketing communications, we retain the relevant contact information for so long as that consent remains valid. You may request deletion of your Account and Personal Information by writing to us at support@saimorphixinnovations.com, subject to our right to retain a copy where required for audit, legal, or regulatory purposes.
7. Your Rights
7.1 Right to Access and Correction
You may request a copy of the Personal Information we hold about you, and may request correction or updation of any inaccurate or outdated Personal Information, by writing to us at support@saimorphixinnovations.com.
7.2 Right to Withdraw Consent
Your consent for the collection, use, and processing of your Personal Information remains valid until withdrawn by you in writing at support@saimorphixinnovations.com. If you withdraw consent, we will stop the relevant processing, except where we have another lawful basis to continue such processing, or where withdrawal would prevent us from providing you the Services you have booked.
8. Security of Information
We implement reasonable security practices and procedures, including physical, technical, and administrative safeguards, that are commensurate with the sensitivity of the information we hold, in line with the SPDI Rules. However, no method of transmission over the internet or electronic storage is completely secure. While we strive to protect your Personal Information, we cannot guarantee its absolute security, and you accordingly agree that your use of the Platform and transmission of information to us is at your own risk. If we become aware of a breach affecting your Personal Information, we will take appropriate steps to investigate and, where required by law, notify you and the relevant authorities.
9. Cross-Border Transfer
Your Personal Information may be stored, processed, or transferred to servers located within or outside India, to the extent permitted under applicable law. By using the Platform, you consent to such transfer, and we will take reasonable steps to ensure that any such transfer is carried out securely and consistently with this Privacy Policy.
10. Third-Party Links and Services
The Platform may contain links to, or integrate, third-party websites, applications, or services (such as the Payment Processor or mapping tools). Once you leave the Platform or interact with a Third-Party Service, you are subject to that third party's own privacy policy, and Grivana is not responsible for the privacy practices or content of any such third party. We encourage you to review the privacy policy of every third-party service you access.
11. Reviews and Testimonials
Where you submit a review, rating, or testimonial regarding the Services or a Provider, we may display it on the Platform, together with your name, with your consent, as contemplated under the Terms of Use.
12. Children's Information
The Services are intended only for individuals who are at least 18 (eighteen) years of age and otherwise competent to contract under the Indian Contract Act, 1872. We do not knowingly collect Personal Information from anyone below this age. If you believe a minor has provided us with Personal Information, please contact us at support@saimorphixinnovations.com so that we may take appropriate action.
13. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for legal or regulatory reasons. Any revised Privacy Policy will be posted on the Platform with an updated "Last Updated" date and will take effect immediately upon posting, unless otherwise stated. Where we make a material change, we will provide notice prior to the change taking effect. We encourage you to review this Privacy Policy periodically. Your continued use of the Platform following any update constitutes your acceptance of the revised Privacy Policy.
14. Grievance Officer
In accordance with the Information Technology Act, 2000 and the rules made thereunder, and the Consumer Protection (E-Commerce) Rules, 2020, the details of our Grievance Officer are set out below.
